1. INTRODUCTORY PROVISIONS

1.1. These General Terms and Conditions (hereinafter “GTC”) govern the rights and obligations between MVP Esports s.r.o., registered at Spálená 108/51, Nové Město, 110 00 Prague, Company ID: 19804229, VAT ID: CZ19804229, registered with the Municipal Court in Prague under File No. C 391860/MSPH (hereinafter “the Operator”), and the customer when booking and using the services of MVP Esports gaming centers.

1.2. These GTC especially apply to the use of gaming PCs, consoles, bootcamp zones, participation in tournaments, use of customer accounts, purchase of gaming time, packages, vouchers, refreshments, and other supplementary services provided at MVP Esports branches (hereinafter “services”).

1.3. The latest information about branches, prices, opening hours, promotions, bookings, and available services is listed on the website https://mvpesports.cz or directly at the relevant branch.

1.4. By using MVP Esports services, the customer confirms that they have acquainted themselves with these GTC, the house rules, and the price list.

1.5. Provisions specified in a particular offer, package, tournament, voucher, or promotional campaign shall take precedence over the general provisions of these GTC.

3. SERVICE BOOKINGS

3.1. Booking of services may be made through the operator’s website, an external booking system, by phone, by email, or directly at a branch.

3.2. The booking system may be provided by a third party, especially the ggLeap / ggCircuit system or another similar technical solution. The operator is not responsible for short-term inaccessibility or technical faults of the external system if not caused by them.

3.3. Online payment for bookings via the MVP Esports website is not generally available unless specified otherwise for a particular service or event. Customers usually pay for services directly at the branch.

3.4. The customer may cancel a booking at any time before its commencement. No cancellation fee is charged for standard cancellations unless specified otherwise for a particular event, tournament, or service.

3.5. The customer is obliged to arrive at the reserved time. If delayed for a longer period, the booking may be cancelled so the place can be offered to other customers.

3.6. The operator reserves the right to cancel or change the booking due to technical, operational, or safety reasons. If this happens, the operator will try to offer the customer an alternative solution.


4. PRICES AND PAYMENT TERMS

4.1. Service prices are listed in the current price list on the website, in the booking system, or directly at the branch. Prices are in Czech crowns and include VAT if charged under legal regulations.

4.2. Payment for services typically takes place at the branch in cash, by card, or by another method approved by the operator.

4.3. Playing on credit is not permitted. The customer is required to pay for services before use or as instructed by staff.

4.4. The operator does not accept damaged banknotes or banknotes that cannot be verified as authentic.

4.5. Discounts, bonuses, promotions, and other benefits cannot be combined unless stated otherwise for a particular offer.

4.6. The operator will issue a tax document or receipt to the customer in accordance with applicable legal regulations.


5. GAMING HOURS, PACKAGES, BONUSES AND GIFT VOUCHERS

5.1. The validity period of purchased gaming hours, packages, season passes, vouchers, bonus hours or promo hours is governed by the terms of the particular offer, tariff, or promo campaign.

5.2. Unused hours are forfeited after the validity period lapses unless otherwise specified in the particular offer.

5.3. Bonus hours, promo hours and other preferential credits are not redeemable for cash and cannot be refunded, unless explicitly stated otherwise.

5.4. Transferring hours, packages, or a customer account to another person is only allowed with the operator’s consent or according to the terms of the specific offer.

5.5. Gift vouchers can be used within the scope indicated on the voucher or when purchased. Unless otherwise stated, gift vouchers are valid for 12 months from the date of issue.

5.6. After the expiry of a gift voucher's validity, it cannot be extended, exchanged for cash, or otherwise compensated unless otherwise agreed with the operator.


6. TOURNAMENTS AND EVENTS

6.1. Participation in tournaments is subject to a fee unless stated otherwise for a specific tournament.

6.2. The conditions of participation, entry fee, tournament rules, registration process, cancellation options, and potential refunds are always specified for each tournament during registration.

6.3. By completing the registration for a tournament, the customer agrees to the tournament's rules and terms.

6.4. The operator reserves the right to cancel, postpone, or change a tournament’s format for organizational, technical, or safety reasons. Should this occur, customers will be informed about the next steps.


7. RULES FOR USING MVP ESPORTS SERVICES AND PREMISES

7.1. The customer is obliged to observe the house rules, follow staff instructions, and behave decently.

7.2. The customer is required to be considerate of other visitors, staff, the equipment and premises.

7.3. The customer must not install prohibited programs, cheats, hacks, illegal software, or other unauthorized software.

7.4. The customer must not disconnect cables, move peripherals between workstations, change device settings, or otherwise tamper with equipment without staff consent.

7.5. Offensive, discriminatory, extremist, pornographic, or otherwise inappropriate content must not be displayed on screens.

7.6. Technical issues, faults, or equipment damage must be reported to the staff immediately.

7.7. The staff have the right to end a session or expel a visitor who violates the rules. Repeated or serious violations may result in temporary restriction or a ban.


8. CHILDREN AND MINORS

8.1. Children under 12 years of age may use MVP Esports services only when accompanied by someone over 18 years old.

8.2. Some services, events, tournaments or games may have a different age recommendation or restriction. Such rules are stated with the specific offer, event, or tournament.

8.3. The legal guardian or accompanying adult is responsible for the selection of games and age-appropriate content for minors.


9. REFRESHMENTS AND ALCOHOL

9.1. Only food and drinks purchased at that MVP Esports branch may be consumed on the premises. Consumption of own food or drinks is not allowed unless staff permit otherwise.

9.2. Alcoholic beverages are sold and served only to persons over 18 years of age. Staff have the right to request proof of age.

9.3. If proof of age is not provided or if there are doubts about a customer’s age, staff may refuse to sell alcohol.

9.4. Alcoholic beverages will not be sold or served to persons obviously under the influence of alcohol or other addictive substances.

9.5. The operator reserves the right to refuse service to any customer whose behavior may endanger safety, order, equipment, or the comfort of others.


10. LIABILITY FOR DAMAGE AND PERSONAL BELONGINGS

10.1. The customer is liable for any damage caused intentionally or negligently to the operator, other customers, or third parties.

10.2. Deliberate damage to equipment, computers, consoles, peripherals, furniture, or the center’s premises is prohibited. Any damage caused must be compensated.

10.3. The operator is not responsible for lost or unattended personal belongings of customers.

10.4. The operator is not responsible for outages, limitations, or faults caused by internet providers, software suppliers, gaming platforms, external booking systems, force majeure, or other circumstances beyond its direct control.


11. SERVICE CLAIMS

11.1. If the customer discovers a problem with a service, technical defect, or other obstacle preventing proper use, they must report it to staff without delay during their visit.

11.2. If the claim is justified, the operator may offer the customer an appropriate substitute solution, in particular extending play time, moving them to another workstation, an alternative date, or other form of compensation.

11.3. Claims can be addressed in person at the branch or by email to the relevant branch’s contact.


12. PERSONAL DATA PROTECTION

12.1. Information on personal data processing is provided in a separate document “Personal Data Protection” available on the operator’s website.

12.2. Information on cookies is provided in a separate document “Cookies Settings”.


13. FINAL PROVISIONS

13.1. These GTC are governed by the laws of the Czech Republic.

13.2. If any provision of these GTC is invalid or ineffective, it shall not affect the validity and effectiveness of the other provisions.

13.3. The operator reserves the right to amend these GTC. The latest version of the GTC is effective from the date of publication on the website, unless stated otherwise.

2. WHAT PERSONAL DATA WE PROCESS

We may process, in particular, the following types of personal data:

• Booking information: branch, date, time, type of service, chosen gaming zone or seat;
• Customer account data: account identifier, service usage history, purchased hours, packages, bonuses and vouchers;
• Payment and purchase data: information required for payment records, receipts, invoices, and accounting documents;
• Tournament and event data: registration, team, results, gaming nickname, communication related to tournaments;
• Communication data: content of messages, inquiries, complaints, or customer requests;
• Marketing data: consent to receive commercial communications, communication preferences, responses to campaigns;
• Technical data from the web: IP address, device type, browser, cookies, and similar technologies according to cookie settings.

If a CCTV system is used in a branch, the relevant area is marked with separate information. Camera records may be processed primarily for the protection of persons, property, and operational security.


3. WHY WE PROCESS PERSONAL DATA

We process personal data mainly for the following purposes:

• creating and managing bookings;
• providing MVP ESports services;
• managing customer accounts, gaming hours, packages, bonuses and vouchers;
• registering and organizing tournaments and events;
• communication with customers;
• handling inquiries, complaints, and claims;
• fulfilling accounting, tax and other legal obligations;
• protecting the rights, property, and safety of the operator, customers, and staff;
• improving services and branch operations;
• sending commercial communications and marketing, when we have a legal reason or consent to do so;
• analyzing website traffic and marketing measurement according to cookie settings.

4. LEGAL GROUNDS FOR PROCESSING

We process personal data on the basis of these legal grounds:

• performance of a contract or taking steps prior to entering into a contract;
• performance of legal obligations, especially in accounting and taxes;
• legitimate interests of the operator, especially for protection of property, operational safety, complaint handling, and improvement of services;
• customer consent, especially for certain marketing activities and selected cookies.

If processing is based on consent, the customer can withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing prior to such withdrawal.

• providers of booking or customer systems, such as ggLeap / ggCircuit or similar services;
• IT, hosting, website management, and technical support providers;
• providers of payment, cash register, and accounting systems;
• accountants, tax and legal advisors;
• providers of mailing, SMS or marketing tools;
• providers of analytics and advertising tools, if used and if there is a legal basis;
• public authorities, if required by law.

We do not sell personal data to third parties.


6. PERSONAL DATA RETENTION PERIOD

We retain personal data only for as long as necessary for the purpose for which it was obtained or as required by law.

In general:

• Data related to bookings and customer accounts is stored for the duration of the customer relationship and then as necessary to protect the operator’s rights;
• Accounting and tax documents are retained for the period required by law;
• Communication data is stored for the time necessary to process the request, and then as necessary to protect the operator’s rights;
• Marketing data is processed until consent is withdrawn or until it is no longer needed;
• Cookies are retained according to individual cookie settings and consents.

• Aggressive, offensive, discriminatory, threatening, or otherwise inappropriate behavior is not permitted.
• It is forbidden to display offensive, discriminatory, extremist, pornographic, or otherwise inappropriate content on the screens.

2. EQUIPMENT AND TECHNOLOGY

• Handle equipment, computers, consoles, peripherals, and furniture with care.
• Disconnecting cables or moving peripherals between workstations is prohibited.
• Changes to technical settings, tampering with devices, or hardware manipulation are allowed only with staff approval.
• Installing unauthorized programs, cheats, hacks, or other unapproved software is forbidden.
• Intentional damage to equipment is prohibited. Any damages caused must be compensated.
• Any problems, faults, or technical issues must be reported to staff immediately.

3. BOOKINGS AND GAME TIME

• Observe your reserved time and finish your session on time.
• If you are significantly late, your booking may be canceled.
• Playing on credit is not allowed.
• If you need to extend your time, please arrange this with staff before your session ends.

4. FOOD AND DRINKS

• Only food and drinks purchased at the MVP Esports branch may be consumed on the premises.
• Consumption of your own food and drinks is not permitted unless authorized by staff.
• Keep your area and surroundings clean.

5. ALCOHOL

9. RULE VIOLATIONS
